We are committed to protecting your personal data in compliance with RA 10173 and its Implementing Rules and Regulations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. What Personal Data We Collect<\/h2>\n\n\n<p>Through our <strong>Doc CARE Pre-Consultation Chatbot<\/strong> and appointment system, we collect the following:<\/p>\n\n\n<ul class=\"wp-block-list\"><li><strong>Identity data:<\/strong> Full name, age, sex<\/li><li><strong>Contact data:<\/strong> Mobile number<\/li><li><strong>Sensitive personal information (health data):<\/strong> Chief complaint, symptoms, duration, severity, medications, allergies, existing medical conditions, surgical history, and additional health notes<\/li><li><strong>Technical data:<\/strong> IP address, browser type, timestamp of submission<\/li><li><strong>Consent record:<\/strong> Timestamp and acknowledgment of this Privacy Notice<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">3. Legal Basis for Processing<\/h2>\n\n\n<p>We process your personal data on the following legal bases under RA 10173:<\/p>\n\n\n<ul class=\"wp-block-list\"><li><strong>Consent (Section 12, RA 10173):<\/strong> You provide explicit, informed consent before any data collection begins through our chatbot.<\/li><li><strong>Fulfillment of a contract:<\/strong> Processing is necessary to provide your teleconsultation service.<\/li><li><strong>Compliance with a legal obligation:<\/strong> DOH Administrative Order 2020-0029 (Telemedicine Guidelines) requires maintenance of patient records.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">4. How We Use Your Data<\/h2>\n\n\n<ul class=\"wp-block-list\"><li>To generate a pre-consultation clinical summary for your attending physician<\/li><li>To enable your doctor to provide a more focused and efficient consultation<\/li><li>To maintain medical records as required by the Department of Health<\/li><li>To respond to data subject rights requests<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">5. AI Processing &#8211; Third-Party Disclosure<\/h2>\n\n\n<p>Your health intake data is processed by <strong>Doc CARE<\/strong>, an AI assistant powered by <strong>Anthropic Claude<\/strong> (Anthropic PBC, San Francisco, USA). This processing is necessary to generate your pre-consultation clinical summary.<\/p>\n\n\n<p>Anthropic processes your data under strict confidentiality and security standards. No data is used to train AI models. You may review Anthropic&#8217;s privacy practices at <a href=\"https:\/\/www.anthropic.com\/privacy\">anthropic.com\/privacy<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Data Retention<\/h2>\n\n\n<p>Your pre-consultation records are retained for <strong>5 years<\/strong> from the date of your consultation, in compliance with DOH medical records retention standards. After this period, your data is automatically anonymized. You may request earlier deletion (subject to legal hold requirements) by contacting our Data Protection Officer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Your Rights Under RA 10173<\/h2>\n\n\n<ul class=\"wp-block-list\"><li><strong>Right to be informed<\/strong> &#8211; You are notified before data collection (this notice).<\/li><li><strong>Right to access<\/strong> &#8211; You may request a copy of your records at any time.<\/li><li><strong>Right to correct<\/strong> &#8211; You may request correction of inaccurate data.<\/li><li><strong>Right to erasure<\/strong> &#8211; You may request deletion of your data (subject to DOH retention requirements).<\/li><li><strong>Right to object<\/strong> &#8211; You may object to specific processing activities.<\/li><li><strong>Right to lodge a complaint<\/strong> &#8211; You may file a complaint with the <strong>National Privacy Commission (NPC)<\/strong> at <a href=\"https:\/\/www.privacy.gov.ph\">privacy.gov.ph<\/a>.<\/li><\/ul>\n\n\n<p>To exercise your rights, contact our Data Protection Officer: <a href=\"mailto:privacy@mykonsulta.com\">privacy@mykonsulta.com<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Minors<\/h2>\n\n\n<p>For patients under 18 years of age, a parent or legal guardian must provide consent and be present during the pre-consultation intake process.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. Data Protection Officer<\/h2>\n\n\n<p>MyKonsulta has designated a Data Protection Officer (DPO) responsible for overseeing compliance with RA 10173.
